Some other points, that would normally come under the Criminal Code but, as some of the descriptions would need to be incorporated into the UCC to avoid confusion, are given below. Ofcourse, these may be left to the Courts to decide on a case-to-case basis.

1. Sex with multiple adult partners, at the same time, is an orgy and should be treated as such. Minors in such orgies should be treated as in case of rape, and all participants considered as rapists or as accessories to rape, for action by the State, on any complaint received, or on its own cognizance.
2. Abortion, for any pregnancy caused due to rape, or incest, should be allowed as desired by mother-to be, or in case of minors, by her un-involved Guardian, before the end of the sixth month, as the fetus is believed to begin to attain consciousness after then. Legal delays after six months should be deemed as approval.

Clarification will also, need to be given regarding some Acts, like the Dowry Act, which are causing considerable confusion and ‘knee-jerk’ reaction from all communities. The misuse of the Dowry Act by many Brides has resulted in many Domestic problems and in confusion, especially in the Muslim community leading to the proliferation of divorce by Triple Talaq (since declared as illegal by the Supreme Court) or such other processes. The misuse of the SC / ST Atrocity Act has also resulted in innocents being victimized. All such Acts need a thorough review to prevent such misuse, or even be struck down.

The recent Joint Parliamentary Committee deliberations on this Bill after consideration of all the comments received from the Public and all other interested Parties, met all such requirements and its decision thereon should be taken as final and now the UCC Act should be promulgated.

Conclusion

Introduction of the Uniform Civil Code need not be immediately applicable to ‘All’, in all circumstances, which could lead to confusion and disputes for many. If done in a proper manner, allowing time for contradictions to resolve themselves and calling for a great measure of voluntary acceptance, it would be a measure welcomed by almost every citizen. There is no need to aim for unattainable perfection. Laws should not futilely attempt to foresee and respond to every situation as may arise in the future. It would be more appropriate to have a good Law that is simple, clear and which lays down the general principles and direction and which allows the Courts to flexibly interpret the implementation, as appropriate from time to time and case to case, in the circumstances and context of that time, is the best solution. Also, the Law for a Uniform Civil Code should be so designed as to receive a great measure of voluntary acceptance on the lines as recomended
here in.
